"Everything depends on the examination and his testimony": a lawyer told what could threaten the traveler who survived in the Sea of Okhotsk

"It all depends on the results of the investigation and what steps Mikhail Pichugin did or did not take to properly equip the boat," says Ivan Solovyov. "As far as I know, he was the owner of an inflatable boat. And he invited his brother and nephew on this trip. Apparently, the bill stipulates that ships can go to sea with certain equipment, including life-saving communication equipment, radios, satellite phones and flares that allow them to send out distress signals. Such cheerful people.

Ideally, the lawyer said, it would have been equipped with a spare engine in case it had to go to sea.

— The main engine may fail. The investigation will conduct tests now. Everything depends on what the surviving travelers testify. What will the investigators find on this ship?

The Honorary Lawyer of the Russian Federation reminds that in connection with the tragedy in the Sea of Okhotsk ("Violation of traffic safety rules and negligence") a criminal case has been opened under Part 3 of Article 263 of the Criminal Code of the Russian Federation. resulting in the death of two or more people ("Marine transport operations"). Investigators are clarifying all the circumstances of the incident.

"But whether anyone will be involved and held accountable depends on the results of the investigation and Mikhail Pichugin's testimony. Now everyone admires how he was able to overcome his fears and survive despite all these difficulties. Of course, this is very cool, but it does not cancel the criminality of the act, if proper measures were not taken to equip the boat before entering the dangerous Sea of Okhotsk.

As Ivan Solovyov said, one should always take into account that the North Sea is very dangerous.

“Everything here seems to have been very arrogantly organized and left to chance. And unfortunately, it led to tragedy. But perhaps the greatest punishment for him was to see his nephew and brother die. Perhaps that will be his greatest punishment. You have to understand that nothing happens anyway. I think there were some shortcomings in the preparation for this trip that led to the tragedy. I believe there is a cause and effect relationship between the lack of equipment on the boat and the tragedy that occurred. Well, the rest will be investigated.

"Now, while Mikhail Pichugin is in the hospital, investigators are already examining the boat. As soon as he regains his strength, his testimony will be accepted. I don't think that anything will be investigated there for a long time. Specific deadlines have been set for the pre-investigation check. It is 30 days. The preliminary investigation period is 2 months. I don't know if I will be able to complete it within the two-month period, but I don't think there is any reason to postpone all this.

— Mikhail Pichugin could face up to 7 years in prison?

- Yes, this clause provides for a term of up to 7 years. However, the court may take into account its nature and the actions taken. In any case, negligence led to the death of people and unintentional harm. In principle, all this is punishable by a suspended sentence. Or maybe give them time to serve in a colony. However, in any case, there must be a criminal-legal assessment of what happened.
