Evgeny Bryun's sentence was written in advance

The Kuzminsky Court of Moscow has issued a verdict in the case of theft of more than 137 million rubles. Budget funds for the purchase of medical products for the detection of drug and alcohol addiction. Despite the fact that the debate between the parties had ended the previous evening at 8:00 p.m., Judge Yulia Frolova continued writing the verdict and was scheduled to announce it at 10:30 a.m. the following day. She entered the courtroom with an impressive stack of papers, declaring that the judicial act was fully prepared, but only announced the introductory and operative parts of the decision under the new rules. This took less than 15 minutes.

In December 2017, she found 74-year-old Evgeny Bryun, former director of the International Practical Center for Narcology, and Sergei Koporov, head of the tender department of the International Practical Scientific Center. According to the prosecution, they were all members of an organized criminal group that operated between 2015 and 2018 and stole 137.7 million rubles from the city budget, which were allocated to the Moscow Practical Narcological Center for the purchase of medical products. Reagents for determining drug and alcohol intoxication, including from persons applying for a driver's license. As a result of the investigation, the products were purchased at clearly inflated prices through organizations controlled by the defendants: Impulsmed LLC and Bitest LLC, Microtechnology LLC and Baila Morena LLC. The scheme involved many contractors, and part of the stolen funds was laundered. In total, the case involved six government contracts, three of which were received by Yevgeny Bryun, who left the post of director of the International Scientific and Practical Center for Narcology and became its president, and three by Sergei Koporov.

Despite the fact that none of the defendants admitted guilt during the trial (most of them were under house arrest, and Sergei Vasiliev was prohibited from certain actions), the court considered this to be proven.

The sentence imposed on the defendant was somewhat more lenient than the state prosecutors had demanded (six to eight and a half years of imprisonment, a fine of 1 to 1.8 million rubles). The minimum term of office is general regime - four years, a fine of 400,000 rubles. The court sentenced Sergei Koporov. Lyudmila Eremenkina and Sergei Vasiliev received two more years, six years each, with a fine of 500 thousand and 1.5 million rubles, respectively. each. The judge sentenced Evgeny Bryun and Vladimir Yakushev to seven years of imprisonment. They will have to pay fines of 850 thousand and 1.5 million rubles. each.

Vladimir Yakushev (47) pleaded guilty at the beginning of the investigation and even discussed cooperating with the prosecution before the trial, but then changed his mind.

However, he transferred 9 million rubles, despite the fact that he did not admit guilt. Compensation for damages is required from the Moscow Practical Center for Drug Science. In this regard, the MNPTS's claim against the defendant is 92.6 million rubles. The court reduced this amount to 83.6 million rubles and ordered the convicted persons to pay this amount jointly and severally.

However, the bill for 44.7 million rubles, presented the day before by the Moscow prosecutor's office, looks like this: In favor of the second victim, the capital's Ministry of Health denied in court that any harm had been caused to him, which the court left without consideration. The Ministry of Health may file a civil suit.

When the deadline was announced, the defendant's hands were in handcuffs. The defendants' lawyers have already stated that they disagree with the verdict and plan to appeal to the Moscow City Court.

According to Yevgeny Bryun's lawyer, Sergei Sebruk, the judicial bill, which is about 400 pages long, was written in advance.

The lawyer stated: "It goes without saying that there is no need to say more about the decision, which was made long before the arguments of the parties and the statements of the prosecutor and the defense were made." He noted that, given the advanced age of Yevgeny Bryun, the seven-year term handed down to him could be equated to the "death penalty."

The lawyer is confident that neither the inflated prices for the purchase of medical products nor the amount of the alleged thefts were proven during the trial. "There is no financial investigation or expert opinion on this case. Two people were injured in this incident. However, one of them, from the first to the last day, claimed to the Ministry of Health that no damage had occurred, that he had been illegally made a victim and that he would not file a claim. "How can we say under such circumstances that the defendant committed fraud?" the defense attorney said. According to him, the director and then president of the International Scientific and Practical Center for Combating Drugs, Evgeny Brun, did not participate in the verification of the applicant's commercial proposal to participate in electronic auctions for the purchase of goods, and "there is no information that the purchased test containers and reagent kits were inflated, and he was not there."

The lawyer claims that none of the approximately 36 witnesses presented in court said that Yevgeny Brun had an agreement with anyone. Mr. Sevruk concluded: "I can only say good things about him, except that he saved thousands of people and created a model system for treating drug addiction in Moscow, which was replicated throughout Russia." He added that the head of the company "Microtechnology" Sergei Vasiliev, who was detained after the verdict was announced, continues to cooperate with international scientific and research associations, although he is already prohibited from performing certain actions during the investigation. He fulfills state contracts for the supply of testing containers to centers and centers for drug addiction practice.
