A nurse dying of cancer gave her apartment to a colleague. And she threw out her 84-year-old mother at night
“Margarita has been suffering from cancer since 2014,” says Elena Zvereva. “She was constantly losing her temper.” She worked as a nurse at the dental clinic of the Russian Railways clinic, where she met another nurse, Ksenia (name changed – Ed.). On October 21, Margarita died. And we learned that the apartment no longer belonged to her. Ksenia won her trust and somehow, unknown to us, persuaded her to draw up a deed of gift. Margarita is a very trusting person. I have fallen for the tricks of scammers many times. In addition, the disease had already made her mentally unstable. I don’t know what she promised there, but Margarita was no longer the owner. But her mother did not sign at first.
- We think that Ksenia was afraid of Margarita. "Margarita didn't tell us anything," Elena said. - By the way, the deed of gift was drawn up a year ago, but Ksenia wasn't going to move. Because if Margarita moved out, questions would immediately arise. We would find out the reason, the case would go to court, and the apartment would be returned. And after the deed of gift was signed, Margarita and Ksenia had a falling out. We didn't communicate at all. Some kind of conflict arose between them. Ksenia disappeared from his life and didn't even attend the funeral.
— At that moment, my grandmother was talking on the phone. She opened the door slightly, and her roommate and lawyer Ksenia entered the apartment. Two police officers were also present. When the grandmother was standing by the door, the lawyer and his partner pushed her out onto the landing and locked her inside. She was wearing only a dress. No clothes or medicine. "I'm hungry and cold." Elena says. - I felt sick. The police and passers-by called an ambulance for her. He is currently hospitalized in the 7th hospital, but he is in good health. She did not end up homeless on the street. After recovery, her son is waiting for her. Another thing is absurd. The police did not even intervene when the grandmother was thrown out. They said they did not want to start a fight. Later, Ksenia and her neighbor threw out the grandmother's things. But everything was disposed of: medicines, Margarita's personal belongings, household appliances purchased by her grandmother. Moreover, they themselves do not live there. They kicked the guy out, changed the locks and left. We plan to continue filing lawsuits.
"From the correspondence between Margarita and Ksenia, it is clear that the girls constantly discuss money," the lawyer says. - Margarita Ryzhenkova transferred utility costs. In addition, after the fact of donation, the apartment was not purchased under the acceptance certificate. This means that the new owner did not accept the apartment after the donation transaction was completed. Ryzhenkova continued to use it and pay for its services. This means that she has problems that prevent her from receiving housing. It is also clear that in the same SMS conversation, having realized that a donation had taken place, he began to demand that the other party return the documents. Margarita wanted to terminate the contract. She also said that she would not have signed the annuity agreement if she had known that she would be taken care of in the last weeks of Ksenia's life before her death. In general, there is chaos in people's heads. She had no idea what she was signing.
"The police received a note from the accused. "There he complained that now that he became the owner, he had to throw out the grandmother," he was indignant. - The important point here is that at that time we had already filed a lawsuit to declare the contract invalid. No actions to register the disputed property can be taken without a court decision. But the police still allowed the grandmother to be thrown out. The pensioner was told to answer the phone near his apartment. When she left, the door was locked behind her and she was not even allowed to take her personal belongings with her. This apartment must be included in the inheritance. Only a court can recognize that an individual has lost the right to use a residential building. Moreover, it is impossible to evict someone who only has one house for the night.
"In this situation, it is advisable to contact law enforcement agencies, including with a request to establish whether the situation with the new owner is systemic, which could result in a series of fraudulent actions," the lawyer explains. "And in order to challenge this, an inspection may be ordered to confirm the legal capacity of the deceased in terms of legal capacity to make transactions. Indirect factors may be used to confirm the version of fraud, such as strange correspondence reported by relatives, and the fact that the deceased did not inform relatives about such strange transactions.
"If there had been law enforcement officers in the apartment, they would probably have seen all the documents from both sides," the lawyer claims. "And it would be advisable to contact the relevant authorities with a request to analyze the police actions from the point of view of maintaining law and order. Because, in my opinion, the behavior described can also be seen as arbitrary.
