Losing land: everyone who owns a plot of land - a new strict rule has been in effect since October 15
Lawyer Irina Sivakova believes that land permanently transferred to spouses during marriage and then privatized is joint property. Therefore, the notary's requirement to obtain the ex-husband's consent to the deed of gift for this plot is considered legal.
However, the Supreme Court of the Russian Federation stated that the notarized consent of the second spouse is not required for transactions with joint property after a divorce. This means that a woman can enter into a land donation agreement with her mother and register it in the Unified Real Estate Register without the consent of her ex-husband.
