Courts will send Russians seeking divorce to a psychologist

Before filing for divorce, the court will require the spouse to consult a psychologist. If a meeting with a specialist does not help save the family, the marriage is dissolved after three months. These bills are awaiting consideration in the State Duma. The text of the document is published on the official website of the legislative body.

"The current family legislation provides that when considering a divorce case, if one of the spouses does not agree to the dissolution of the marriage, the court has the right to take measures to reconcile the spouses and set a reconciliation period of three days. months. "This draft federal law introduces the obligation of the courts to apply the said measures," the explanatory note to the bill says.

Psychological consultation is recommended in two cases: when one of the spouses does not want to separate and when there are minor children together. According to the current legislation, judges can take steps to reconcile the spouses, but are not obliged to do so. There are many families that break up without being able to find a reason. The new version of the law requires courts to at least try to reconcile quarreling couples. And not only give you time to think, but also send a divorce application to a family psychologist and postpone the consideration of the case for three months.

According to state representative Igor Antropenko, one of the authors of the bill, the current process of judicial reconciliation boils down to the fact that either no one works with the spouses, or they just wait until the couple receives advice on the division of property and the resolution of contentious issues. There are many cases. With children. "Such assistance can to some extent lead to divorce. Perhaps it will be easier for someone to decide on this step, because it helps resolve contentious issues," he told URA.RU.

According to the agency's interlocutors, his legislative initiative will help save the marriage. "According to a VTsIOM survey, 15% of respondents named a lack of mutual understanding as the reason for divorce. Young people are often impulsive and absent-minded, and sometimes they don't even have anyone to consult with. And here we see great potential for the work of family psychologists," he said. The deputy director is confident that even if the innovation helps save families in 5-10% of cases, the measures will already be justified.

At the same time, the representatives emphasized that the changes in the law do not mean additional difficulties in divorce. According to him, "no one should be forced to consult a psychologist." If both or one of the spouses avoid the opportunity to consult a specialist, the marriage will be dissolved after three months.
